Marco Malesani
Born in Bologna on the 8th September 1958. He graduated in law in 1983 summa cum laude from the University of Bologna. His thesis was in the area of commercial law on the topic of ‘Groups of Company’ (‘I Gruppi di società’), thesis supervisor, the late lamented Professor Gerardo Santini.
He joined the firm in 1984 and was admitted to the Bar in 1996. He began practising law in 1992 and qualified to plead cases in the High Court in 2001. He practises law in the areas of national and international commercial law, bankruptcy and intellectual property law. In 1989 he obtained a Ph.D in commercial law at the Bocconi University, Milan, based on a thesis entitled ‘Groups of Company and conflicts of interest’ (‘Gruppi di Società e conflitti di interessi’).
He provides legal advice (a service which he can also provide in English when required) on commercial contracts and company transactions (mergers and acquisitions, sale and purchase of companies and company subsidiaries). In addition to the above activities, from 1989 onwards he began to specialise in information technology law, specifically in the drawing up of contracts relating to software. In this area, he has offered and continues to offer legal consultancy to companies involved in the production and development of software aimed at the banking sector and the outsourcing of IT services for credit institutions. He also handles the drawing up of contracts and necessary legal documentation for the creation and development of Internet portals (sponsorship of websites and banners, storage of banking data, e-commerce etc.), assisting the firm’s client companies in contractual problems related to the area of IT and any attendant judicial, arbitration and extrajudicial disputes. In recent years he has also specialised in contracts relating to the energy sector, dealing with both traditional and renewable energy sources. He has, in addition, acted as arbitrator, often as sole arbitrator, in arbitration proceedings.
